The Court distinguished Nasik Municipal Corporation v. Harbanslal Laikwant Rajpal [(1997) 4 SCC 199], noting its inapplicability to the present case where substantial prejudice was caused. Ext.P3 and subsequent awards were set aside, with directions to the District Collector to conduct fresh proceedings under Section 21, ensuring a hearing on quarrying, diminution of land value, and its extent, before passing awards under Section 23.
Held: The impugned order reducing land value by 80% without notice or hearing violated Section 21 of the 2013 Act. The District Collector was directed to provide a proper opportunity of hearing to the petitioners and pass reasoned awards, considering objections on land classification and value.
