2025 KER 43645 : 2025 (4) KLT 1
High Court of Kerala
Dr. A.K. Jayasankaran Nambiar & P.M. Manoj, JJ.
WA Nos. 1691 of 2023, 633 & 1441 of 2025; June 17, 2025

Exemption under Section 81(3) of the Kerala Land Reforms Act, 1963, permitting use of land for commercial/industrial purposes, prevails over restrictions under the Kerala Conservation of Paddy Land and Wetland Act, 2008, when the land is used as per the exemption conditions. Harmonious interpretation of both statutes deems an exemption under Section 10 of the 2008 Act, allowing the landholder to retain benefits of the exemption without interference from the 2008 Act’s provisions.

Writ Appeals Nos. 1441 and 633 of 2025 allowed; Writ Appeal No. 1691 of 2023 dismissed.
